Application of the general terms and conditions of sale
The present terms and conditions apply to the sale of products by Ampelidae on its Internet and telephone store. They are automatically made available to the buyer on the home page of the Ampelidae website.
Simply click on “General Terms and Conditions of Sale” (hereinafter referred to as G.T.C.) to view the terms and conditions of your order, even before you begin the ordering process.
Consequently, the act of placing an order implies the buyer’s full and unreserved acceptance of these G.S.C., to the exclusion of all other documents such as prospectuses and catalogs issued by the seller, which are for information purposes only.
The fact that the seller does not avail itself at a given time of any of the provisions hereof may not be interpreted as a waiver of the right to avail itself at a later date of any of the said conditions.
Our offers are exclusively reserved for private customers, to the exclusion of professional resellers.
Loyalty and affiliation programs are strictly reserved for special customers. Orders are confirmed by invoice, but are not final until full payment has been received.
Price
Indication :
Prices are indicated in Euros (¤) or in local currency. They include VAT and exclude shipping costs. Subject to typographical and display errors.
– Products delivered in METROPOLITAN FRANCE and CORSICA: prices include VAT and French duties.
– By exception, vins primeurs are quoted exclusive of VAT. In this case, VAT at the applicable rate and excise duty in force at the time of delivery, i.e. 1 to 2 years after the order, will be added.
Invoicing:
Invoicing: A detailed invoice is available on request. Invoices are issued in Euros (€). All bank payments are made in Euros.
Minimum quantity
Certain references will be subject to a minimum order quantity. This particular condition is clearly specified on the site for each of the references concerned.
Shipping costs
Principles for calculating shipping costs:
Shipping costs are calculated according to the place of delivery and the number of items ordered.
When you place your order, we offer several delivery options. The choice is yours!
– Delivery Normal mode:
Price: 25.00 Euros for delivery in France.
Delivery times: Orders are prepared and dispatched within 24/48 working hours of receipt of payment. Normal Mode delivery (entrusted to our carriers) takes place within 10 days of your order.
– Collection from our winery:
Price: Free delivery on orders picked up at our winery in Marigny Brizay (86380), Château des Roches, Route d’Ouzilly.
Delivery time: Orders are prepared and available in the store within 24/48 working hours of receipt of payment for your order.
– Free delivery:
Price: Delivery is free in mainland France for all orders equal to or greater than 18 bottles of 75 cl (or equivalent in weight).
Delivery mode & times
Delivery is made by the carrier to the address indicated by the customer at the time of ordering (or by a notice of availability in the absence of the customer). The delivery address must be in Metropolitan France.
Delivery times:
Delivery times vary according to the type and location of delivery. They run from verification of customer data by Ampelidae in the case of delivery without prior payment, and from receipt of payment or bank authorization in the case of delivery with prior payment (online credit card).
Guaranteed delivery times do not apply to the sale of primeur wines.
In any case, delivery must take place within a maximum of thirty (30) days from the transmission of the order. If delivery cannot be guaranteed within this period, the customer will be informed as soon as possible and may cancel the order. They may then request an exchange of the product or a refund.

Terms of payment
General conditions
The price of the items ordered is payable in full to Ampelidae, as soon as your order form is issued on the site, using one of the following methods of payment:
– by credit card (secure online payment or communication of the number, expiry date and holder by telephone, fax or post),
– by bank or postal transfer,
– by Payplug
On receipt of your payment, we will send you the wines together with your final invoice showing the amount of VAT at the current rate (currently 20%), excise duty and the contribution to transport and delivery costs.
Payment methods
1 – Internet: secure credit card payment
We have set up a secure credit card payment procedure for you on the Internet. This procedure is based on information encryption technology, the benchmark for secure payment.
How do I place a credit card order on the site?
When you pay, you enter your credit card number and expiry date, which are immediately encrypted on your computer before being sent over the Internet. In this way, no confidential information circulates on the network without first being encrypted.
Please note: only cards bearing the initials CB, VISA, EUROCARD, MASTERCARD or AMERICAN EXPRESS are accepted.

Transport & liability
Goods are shipped at your expense and risk. It is therefore your responsibility to check the contents of the package at the time of delivery and to express any reservations as follows:
On the delivery slip provided by the carrier.
And, in all cases, by notifying the company Ampelidae by registered letter AR addressed to its administrative headquarters (Ampelidae, Château des Roches, 86380 Marigny Brizay) within three (3) days of receipt of the package.
In the event of breakage or damage during the preparation of the order or delivery, Ampelidae will make the necessary arrangements to redeliver to you, or otherwise reimburse you the amount paid at the time of ordering. Your account will be re-credited and Ampelidae’s account will be re-debited accordingly. YOU WILL BE NOTIFIED BY OUR CUSTOMER SERVICE DEPARTMENT.
Product return
Your right
Pursuant to Article L. 121-16 of the French Consumer Code, you have the right to return, at your own expense, the product within fourteen (14) days of delivery, in good condition and in its original packaging with the original invoice, for exchange or reimbursement of an amount corresponding to the value of the returned product as well as the initial shipping costs.
For primeur wines, you have a period of fourteen (14) clear days from receipt of your pro-forma invoice to request modification or cancellation and reimbursement of your order. After this period, your order will be considered final.
Payment of return shipping costs
Ampelidae will only pay for return shipping costs (at the current base rate) if one of the following two conditions is met:
The delivery does not conform to the order, or you have made reservations with the carrier (see article 9: transport and liability). In this case, please contact our customer service department, whose contact details are given in article 14.
Reservation of ownership
Ampelidae remains the owner of the goods sold until full payment has been received. Full payment shall constitute transfer of ownership, however the purchaser shall become responsible for the items upon delivery, and transfer of possession shall constitute transfer of risk.
Resolving the contract
In the event of non-payment by the customer on the agreed due date, and one month after formal notice has been served without result, the sale will be cancelled by operation of law at the seller’s discretion, with the return of any advance payments made by the purchaser, and the possibility for the seller to request in summary proceedings the return of any products already delivered, without prejudice to other damages. In the event of collection by means of litigation, the latter will give rise to a fixed indemnity amounting to 15% of the amount of the order.

In order to meet your needs and provide you with the best possible remote service, we may record certain information about you (surname, first name, address).
You may receive, through Ampelidae, proposals from other companies or organizations, or be informed of Ampelidae offers by telephone, mail or e-mail.
If you do not wish to do so, simply write to our customer service department stating your full name and address, or change your details on the “Your basket” page.
In accordance with the French Data Protection Act of January 6, 1978, you have the right to access and correct your personal data.
You can also have them rectified by contacting our customer service department.
You have the option of registering free of charge on a BLOCTEL cold calling opposition list(www.bloctel.gouv.fr) in order to no longer be cold-called by a professional with whom you have no current contractual relationship, in accordance with the French consumer law no. 2014-344 of March 17, 2014.

Bank details
In addition, all the bank details you send us when making an online purchase are neither stored nor visible on the Internet. No one can intercept the information you send. Ampelidae’s SSL security system guarantees the confidentiality of your data.
The information relating to your order is subject to automated data processing for the purpose of defining a transaction analysis level and combating credit card fraud.
PAYBOX and the merchant from whom you make your purchase are the recipients of the data relating to your order. Failure to transmit your order data will prevent your transaction from being processed and analyzed.
The occurrence of an unpaid order due to fraudulent use of a bank card will result in the registration of the details relating to your order associated with this unpaid order in a payment incident file set up by PAYBOX. An irregular declaration or an anomaly may also be subject to specific processing.

Contract concluded by a consumer ordering from another country
This contract is governed by French law. Any dispute arising in connection with the performance or interpretation of this contract shall be brought before the competent courts in accordance with the directives and regulations of the European Union (in particular the Brussels Convention, September 27, 1968).
Protection of minors
In accordance with article L. 3342-1 of the French Public Health Code, which stipulates that the sale of alcohol to minors under the age of eighteen (18) is prohibited, you undertake, by completing the order form, to have reached the age of eighteen (18) by the date of the order by ticking the appropriate box.

Packaging
Article 62 of the anti-waste law for the circular economy (AGEC law) adopted on February 10, 2020 provides for the introduction of a unique identifier for all companies or entities subject to the principles of Extended Producer Responsibility (EPR).
From January 1, 2022, Ampelidae will have a unique identifier generated by the French Agency for Ecological Transition (ADEME). Specific to each EPR, it identifies each company or entity registered with an approved company and subject to the EPR principle.
